Federal Court Mandates Release of Abrego Garcia from ICE Detention

A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in federal custody.

In her decision, the judge pointed out that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.
